Terms of Service

These Terms of Service ("Terms") govern access to and use of the websites, applications, and services operated by Founder Market Fit ("Founder Market Fit," "we," "us," or "our") at foundermarketfit.co and related properties (the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. The Services

Founder Market Fit provides tools that help individuals assess fit between their background and potential venture, product, or career opportunities. Features may include intake of materials you provide or nominate, evidence extraction, interview flows, automated matching, dossiers, and related operator/admin tooling. Features may change, be limited, or be discontinued at any time.

Not professional advice. Outputs are informational decision-support only. They are not legal, financial, investment, tax, career, or other professional advice. You remain solely responsible for decisions you make.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

3. Accounts and security

  • You must provide accurate information and keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
  • Notify us promptly at hello@foundermarketfit.co if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms or pose risk to the Services.

4. Your content and permissions

"User Content" means materials you submit or authorize us to fetch, including résumés, interview answers, notes, nominated URLs, and profile or portfolio pages you ask us to read.

  • You retain ownership of your User Content. You grant Founder Market Fit a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create derivative works (such as evidence extracts, match scores, and dossiers) solely to provide and improve the Services.
  • You represent that you have all rights necessary to submit User Content and to authorize processing of nominated URLs, and that doing so does not violate law or third-party rights (including website terms that prohibit scraping where you are not authorized).
  • You agree not to upload malware, unlawful content, or others' confidential information without authorization.
  • You may remove sources or request deletion as described in the Privacy Policy; copies may remain in backups for a limited period.

5. Acceptable use

You will not:

  • Use the Services for unlawful, harmful, fraudulent, or deceptive purposes;
  • Attempt to access others' accounts or data without authorization;
  • Reverse engineer, scrape, or overload the Services except as allowed by law;
  • Interfere with security or integrity of the Services;
  • Use outputs to harass, discriminate unlawfully, or make automated decisions that produce legal or similarly significant effects on individuals without appropriate human review and legal basis;
  • Misrepresent our recommendations as guarantees of funding, employment, revenue, or market success;
  • Resell or provide the Services to third parties except with our written permission.

6. Third-party sites and models

The Services may fetch content from third-party websites you nominate and may use third-party AI model providers to process User Content. Those third parties have their own terms and privacy practices. We are not responsible for third-party sites, their availability, or their content. Fetch failures may be shown as failures; incomplete third-party data can limit recommendation quality.

7. Intellectual property

The Services—including software, design, trademarks, logos, and documentation—are owned by Founder Market Fit or its licensors and are protected by intellectual property laws. Except for the limited license to use the Services as provided in these Terms, no rights are granted. You may not use our marks without prior written permission.

Feedback you provide may be used by us without restriction or compensation to improve the Services.

8. Fees

Some features may be free; others may require payment in the future. If paid plans are offered, prices, billing terms, and refunds (if any) will be disclosed at purchase. Unless stated otherwise, fees are non-refundable except where required by law.

9. Confidentiality

We treat your assessment materials as confidential and process them as described in the Privacy Policy. You agree not to disclose non-public operator credentials, invite tokens belonging to others, or non-public features of the Services.

10. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that outputs will be accurate, complete, or suitable for your situation, or that the Services will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, Founder Market Fit and its officers, directors, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Services or these Terms, whether based in contract, tort, or otherwise, even if advised of the possibility. Our aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amounts you paid us for the Services in the twelve (12) months before the claim or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

12. Indemnity

You will defend, indemnify, and hold harmless Founder Market Fit and its personnel from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if continuing would create risk. Upon termination, your license to use the Services ends. Sections that by nature should survive (including intellectual property, disclaimers, liability limits, indemnity, and governing law) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Except where prohibited, disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property or unauthorized access claims.

Informal resolution: Before filing a claim, you agree to email hello@foundermarketfit.co with a brief description of the dispute and to attempt good-faith resolution for 30 days.

15. Export and sanctions

You may not use the Services if you are prohibited under U.S. or other applicable export control or sanctions laws.

16. Changes to the Terms

We may modify these Terms by posting an updated version on this page and updating the "Last updated" date. Material changes will take effect upon posting or as otherwise stated. Continued use after changes become effective constitutes acceptance.

17. Miscellaneous

  • These Terms and the Privacy Policy are the entire agreement between you and Founder Market Fit regarding the Services.
  • If any provision is unenforceable, the remainder remains in effect.
  • Failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale.
  • There are no third-party beneficiaries except as expressly stated.
